Purchase Terms

These Purchase Terms apply every time you enter a sealed-bid round on Public Auction, a DBA of Lemon LLC ("Public Auction," "we," "us"). You accept them by checking the agreement box at checkout. Please read them — they explain what you are charged and when.

1. How a sealed-bid round works

Each item is offered as a round with a fixed number of spots. To enter, you pay a non-refundable entry fee and submit one sealed bid (hidden from everyone). When the last spot fills, the round settles instantly: the highest bid wins. Ties are broken by who bid earliest.

2. What you are charged

Entry fee — charged now, non-refundable. Your entry fee is charged when you check out and is not refundable, whether or not you win. Entry fees fund the seller's listed price.

Your bid, sales tax, and shipping — authorized as a hold, charged only if you win. At checkout we place an authorization hold covering your bid plus any applicable sales tax and shipping. If you win, that amount is captured. If you do not win, the hold is released and you are charged nothing beyond the entry fee.

3. No opt-out

Checking the agreement box and completing checkout is a commitment to the round. There is no opt-out or cancellation of your entry once submitted. Please bid an amount you are comfortable paying if you win.

4. If a round never fills

If a round does not fill and is canceled, the sale does not occur: your entry fee is refunded and any bid hold is released.

5. Who you are buying from

You buy from the independent seller who listed the item, not from Public Auction. The seller is the merchant of record. Payments are processed directly by the seller's own payment processor — Public Auction does not hold or custody buyer funds and takes no part of the sale. Card details are handled by the processor, not by Public Auction.

6. Sales tax

Applicable sales tax is added to a winning purchase unless the seller states the price is tax-included. Tax is determined based on the shipping address you provide.

7. Shipping & delivery

The seller ships the item, or charges a stated flat shipping rate, as shown on the listing. Delivery times and shipping methods are set by the seller. Provide an accurate shipping address; you are responsible for its accuracy.

8. Returns

Returns and refunds for delivered items are governed by the seller's posted return policy. Because entry fees and winning purchases are processed by the seller, refund requests are handled with the seller.

9. Disputes

Issues with an item or order are resolved with the seller under their policies and applicable law. Public Auction may assist but is not a party to the sale.

10. Disclaimers & limitation of liability

To the fullest extent permitted by law, the Platform and transactions are provided "as is," and Public Auction is not liable for indirect, incidental, or consequential damages arising from a purchase. Nothing here limits liability that cannot be limited under applicable law.

11. Changes

We may update these Purchase Terms; the version and effective date above will change. The terms in effect at the time of your checkout apply to that purchase.
