Account Terms of Service

These Account Terms ("Terms") govern your account with Public Auction, a DBA of Lemon LLC ("Public Auction," "we," "us"), and your use of the Public Auction marketplace (the "Platform"). By creating an account you agree to these Terms. Purchases you make are also governed by the Purchase Terms. If you choose to sell, a separate Seller Agreement applies to sellers.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. You agree to provide accurate account information and to keep it up to date.

2. Your account

You are responsible for activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms or that we reasonably believe pose a risk to the Platform or its users.

3. Acceptable use

You agree not to: access the Platform with bots, scrapers, or other automated means except as we expressly permit; copy, harvest, or resell Platform data or listings; interfere with or overload the Platform; attempt to gain unauthorized access; or use the Platform for unlawful, deceptive, or abusive purposes.

4. Purchases

Buying on Public Auction uses a sealed-bid model with non-refundable entry fees. The full mechanics and payment terms are described in the Purchase Terms, which you accept at checkout.

5. The Platform's role

Public Auction provides marketplace technology that connects buyers with independent sellers. Sellers — not Public Auction — list items, set prices and policies, receive payment through their own payment processors, and fulfill orders. Public Auction is not the seller or merchant of record for items sold by sellers.

6. Communications

By providing an email address or phone number, you agree to receive service messages related to your account and orders (for example, confirmations and results). Messaging rates may apply to texts.

7. Privacy

We handle personal information in accordance with our Privacy Policy. We do not sell your personal information.

8. Disclaimers & limitation of liability

The Platform is provided "as is" without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Public Auction is not liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot be limited under applicable law.

9. Changes

We may update these Terms. If we make material changes, we will update the version and effective date above and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.
